November 13, 2017

The Regular Meeting of Council was called to order by Mr. Moran, President of Council, at 7:00 p.m. in the David J. Cook Council Chambers.

Council Members Present: Mr. Hunt, Mr. O’Donnell, Mr. Furry,

The meeting was opened with the Pledge of Allegiance.

MOTION:

Moved by Mr. Moran, seconded by Mr. O’Donnell, that the reading of the minutes of the Legislative Meeting of October 23rd, the Special Meeting and the Committee-of-the-Whole Meetings of November 6th be waived and that the minutes be accepted as submitted.

MAYOR’S REPORT:

The Mayor shared Building Department statistics through October: 14,012 building permits have been pulled as compared to 13,002 permits last year. The total valuation for last year was $19,700,000 as compared to $29,600,000 this year, almost an additional $10,000,000 of valuation.

The Mayor commended Chief Lenart along with Chief Gilman from the Lakewood Fire Department, who along with ODOT marked the overpasses on I 90. This will allow citizens to know exactly where they are located on I 90 in case of an emergency.

Director Reyes announced at the morning meeting that the salt spreaders are on and ready to go when needed.

The Wooster/Shoreland Pedestrian Safety Project has commenced. The city was awarded the funding for this project in the first round from the Community Development Supplemental Grant Program initiated by the County.

There will be an Airport Metroplex Public Workshop hosted at the Rocky River Civic Center on December 5th from 5:00 – 8:00 p.m. This is to provide the community along with surrounding Rocky River City Council Legislative Meeting November 13, 2017 Page 2 of 11

communities a draft of the environmental assessment of the implementation of the Metroplex Project. This is for Cleveland Hopkins and the Detroit Metropolitan Wayne County airports along with 10 satellite airports. This project includes changes in flight routes and altitudes, but does not increase the numbers in air traffic and does not add additional ground disturbance. Public comment is open now through December 11th.

Thursday, November 16th is the Winter Market on Linda Street with more than 40 vendors from 6:00 – 10:00 p.m. Auxiliary police will be on hand and will be collecting new items along with cash for the City Mission.

Friday, November 17th is the Olde Tudor Row Holiday kick-off from 6:00 – 9:00 p.m.

Wednesday, Mike Foley, the Sustainability Director for the County, will be providing a solar energy workshop for residents of the Westshore area.

Friday will be the Senior Center’s Thanksgiving dinner. Doors will open at 5:00 p.m. with dinner being served at 6:00 p.m. The Cleveland Women’s Orchestra will perform at 7:30 p.m.

The Mayor announced that several students from Rocky River High School and Lutheran West High School raked out 11-15 yards for seniors in the city. The Mayor extends her thanks on behalf of the seniors.

The Mayor respectfully requested an Executive Session under Article 10, Section 6, Subsection 3, to discuss a legal matter.

LAW DIRECTOR’S REPORT:

Law Director Bemer added that First Energy should have representatives at the Solar Energy Workshop sponsored by County Director Foley especially if there is a situation where unused solar generation could be sold back to the grid.

A Planning Commission Meeting is also scheduled for this Wednesday. The agenda items are as follows: Preservation Partners project on Lake Road and Breezevale Cove. This is a pre-preliminary review. Also, another new project on the east end of Hilliard Blvd. Previously there was a group of eleven townhouses approved by Planning Commission a few months ago. That project is not going forward. The owners are now looking at the prospect of a multi-family project which will require rezoning. This will also be a pre-preliminary review by the Planning Commission which provides a little bit of direction but without any right of reliance on any representation or statements that are made. There will be another Planning Commission Meeting on November 30th.

 Mr. Sindelar asked what happened with the project prior to this one on Hilliard Blvd. Mr. Bemer said that the hurricanes caused the prices to increase and the owner was marketed out of that project.

 Mr. Furry asked if this will have the same deed restrictions as was encountered on the Rockcliff Project. Mr. Bemer said there are some but not nearly as rigorous as the Rockcliff project. The MetroParks will be involved in this.

 Mr. O’Donnell asked if the Brickman project has been redesigned. Mr. Bemer said it has been redesigned. It is no longer a glass-blocked structure but is brick and sandstone. The Mayor added that the demolition occurred last week. This new project involves Breezevale Cove.

 Mr. Moran asked if the city needed to add anything specific regarding drones intruding the air space. Mr. Bemer said that the FAA promulgated regulations regarding drones but the State of Ohio has not.

COMMUNICATIONS AND ANNOUNCEMENTS: Mr. Moran said that Council has begun setting appointments regarding the Budget Hearing scheduled for December 1st.

Mr. Furry said that this has been discussed for a month and a half. Mr. Furry added that there is a substitution on the lease agreement where property damage was reduced to $20,000. Mr. Furry moved to amend by substitution the lease agreement for Ordinance No. 73-17, seconded by Mr. Sindelar.

This was discussed at length last week during the Special Meeting. Mr. Mehling and Mr. Balla both spoke at the meeting. This ordinance seeks to replace two HVAC units that cover the lobby and south locker rooms at the Hamilton Ice Arena. There is a hockey tournament scheduled over the Thanksgiving weekend.

Mr. Klym moved that the rule requiring that Ordinance No. 96-17 be read on three separate days be suspended, seconded by Mr. Furry, as the heat needs to be restored prior to the Thanksgiving tournament.

 Mr. Klym asked if there will be retroactive payments to the beginning of the year. The Mayor said yes and the administration is working on the 2018 wage ordinance.

ORDINANCE NO. 97-17 BY: JAMES W. MORAN

AN EMERGENCY ORDINANCE TO MAKE APPROPRIATIONS FOR THE CURRENT EXPENSES OF THE CITY OF ROCKY RIVER, OHIO, DURING THE FISCAL YEAR ENDING DECEMBER 31, 2018

Mr. Moran discussed the budget meetings in December. The Mayor commented on the almost $72,000,000 in appropriations. These appropriations account for not only the City of Rocky River, but also the multi-jurisdictional court and the regional Wastewater Treatment Plant and Capital. The Mayor complimented and thanked Council on the amount of work they do on the budget. This Council is one of the only Councils in the County that has this amount of work in terms of the budget. Mr. Moran is pleased that the budget is passed prior to the beginning of the year and temporary appropriations are not needed.

ORDINANCE NO. 98-17 BY: JOHN B. SHEPHERD

AN EMERGENCY ORDINANCE AUTHORIZING THE MAYOR AND THE DIRECTOR OF PUBLIC SAFETY-SERVICE TO RENEW A CONTRACT FOR VARIOUS INSURANCE COVERAGES FOR THE CITY OF ROCKY RIVER WITH MCGOWAN INSURANCE FOR THE YEAR 2018 AT A TOTAL COST OF $196,832.00

The McGowan Insurance Company has been the city’s insurance company for years. Director Costello said McGowan has been helpful in guiding the city. This will be a 3-4% increase. This will be discussed further at next week’s meeting.

This is a renewable contract. Jackson Dieken & Associates have been the agents for the last ten years. This is a three-year rate guarantee and this is the second year for it.

This is a companion ordinance to 71-17, allowing the City to purchase tires on the open market. This is an annual cost saving ordinance.

AN ORDINANCE AUTHORIZING THE MAYOR TO RENEW THE HEALTH CONTRACT FOR THE YEAR 2018 WITH THE GENERAL HEALTH DISTRICT OF CUYAHOGA COUNTY, OHIO FOR SERVICES TO THE CITY OF ROCKY RIVER, IN THE AMOUNT OF $4.12 PER CAPITA, NOT TO EXCEED $83,278.00 ATTACHED HERETO AS EXHIBIT “A”

Mr. Klym indicated this is an annual ordinance to help provide the necessary medical, nursing, sanitary, laboratory and other health services and air pollution control that we are required to provide by the Ohio Revised Code. This is a renewal of the contract and it has no increase from the price last year.

Mr. Moran moved to approve the Consent Agenda, Ordinance No. 71-17, 72-17 and 74-17, seconded by Mr. O’Donnell.

President Moran announced that Council, Mayor Bobst, Law Director Bemer, Director Costello and Director Thomas will recess to Executive Session at 7:55 p.m. and thanked the audience for their attendance.

President Moran reconvened to the Regular Meeting of Council.

As there was no further business by members of Council, the meeting was adjourned at 8:08 p.m.
